Terms of Service

1. Eligibility

You must be at least 18 years old or represent a legal entity authorized to enter into this agreement.

2. Account and access

You may need to register for an account and obtain API keys or authentication tokens. You are responsible for keeping your credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized access.

3. Roles

Clients create and manage ad campaigns. Their responsibilities include funding campaigns according to their account balance and ensuring ads comply with applicable laws.

Publishers display ads or integrate analytics on their sites. Their responsibilities include correctly integrating scripts and components, ensuring websites comply with applicable laws and do not host prohibited content, and not manipulating metrics or tracking.

4. Use of services

Services must be used only for lawful purposes. You are responsible for content you submit or display through our Services. Prohibited uses include illegal products or services, adult content or pornography, malware, phishing or harmful software, misleading or fraudulent content, and hate speech, violence, or discrimination. We reserve the right to block or remove content that violates these Terms.

5. Data collection and privacy

Analytics may collect interaction data, including clicks, scrolls, hover time, time on an element, and aggregate user behavior. User identifiers are anonymous and stored locally. Publishers are responsible for complying with local privacy laws. We do not collect personal information such as emails or logins unless explicitly disclosed.

6. Payments and refunds

All payments for Services are non-refundable. Once funds are added to your account or allocated to campaigns, they cannot be withdrawn, reversed, or refunded unless otherwise explicitly agreed by Euphant.

7. Intellectual property

Clients retain ownership of ad content. Publishers retain ownership of site content. Euphant retains ownership of all software, scripts, and tools. You may not copy, redistribute, or reverse-engineer our software without permission.

8. Termination

We may suspend or terminate access for violations of these Terms. Users may terminate their accounts by contacting support. Pending budgets or payments may be forfeited unless otherwise agreed.

9. Disclaimer

Services are provided “as is” without warranties. We do not guarantee specific performance or revenue. Publishers integrate scripts at their own discretion; Euphant provides guidance for safe integration.

10. Limitation of liability

We are not liable for indirect, incidental, or consequential damages. Total liability is limited to fees paid in the preceding three months.

11. Changes to terms

We may update these Terms at any time. Continued use constitutes acceptance of updated Terms.

12. Governing law

These Terms are governed by the laws of Japan, without regard to conflict-of-laws principles.
